The decision in the case brought by fellow blockchain software developer Tari Labs raises questions about trademark enforcement in the open source community.

David Leichtman, a managing partner at law firm Leichtman Law PLLC, said what a brand is protecting “is the value of the brand,” including its name or logo. That‘s the key issue of the Yuga Labs lawsuit.

The suit involved the developer of websites and a smart contract to sell “misleading” RR/BAYC NFTs. There are separate ongoing cases regarding Ryder Ripps‘ use of Bored Apes‘ imagery.
